MagmaSync

1. Effective Date

These Terms and Conditions are effective as of the date listed above and apply to all users of the MagmaSync mobile application.

2. Acceptance of Terms

By downloading, installing, or using the MagmaSync mobile application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms apply in addition to any terms imposed by the Apple App Store and Apple's standard End User License Agreement (EULA).

3. Description of Service

MagmaSync is an iOS application that provides informational monitoring of Kīlauea volcano in Hawaii. The App displays volcano alert levels, aviation color codes, observatory messages, AI-generated eruption forecasts, AI-powered summaries, and push notifications.

All information is sourced from public data published by the U.S. Geological Survey (USGS) Volcano Hazards Program and the Hawaii Volcano Observatory (HVO), unless otherwise noted. The App is intended for general informational and educational purposes only.

5. No Warranties / Data Accuracy

Specifically:

• USGS Data Accuracy: Data sourced from the USGS Volcano Hazards Program is provided in good faith but may be subject to transmission delays, processing latency, or temporary outages. MagmaSync does not guarantee that data displayed in the App matches the most current USGS publications at any given moment.
• Data Delays: Alert levels, aviation color codes, and observatory messages may be delayed relative to when they are published by HVO. Time-sensitive safety decisions must not be based on data from this App.
• No Warranty of Availability: The App and its data services may be temporarily unavailable due to network conditions, server maintenance, or other factors outside our control.

6. AI-Generated Content

AI Eruption Forecasts: Eruption forecast windows displayed in the App are generated by artificial intelligence models and are not official USGS or HVO forecasts. These forecasts:

• Are inherently probabilistic and may be incorrect
• Cannot predict volcanic activity with certainty
• May not reflect the latest monitoring data
• Should not be used to make evacuation or safety decisions

AI Summaries (Apple Intelligence): Observatory message summaries are generated on-device by Apple Intelligence, a feature of Apple Inc.'s operating system. These summaries:

• Are machine-generated and may be inaccurate, incomplete, or misleading
• May omit critical information present in the original message
• Do not represent official HVO communications
• Should not be relied upon for safety decisions

Always read the original observatory message for complete and accurate information.

7. Notification Disclaimer

Push notifications provided by MagmaSync are for informational purposes only and are subject to:

• Network delivery delays
• Processing and queuing delays in Firebase Cloud Messaging
• Device-level notification throttling or suppression by iOS
• Potential delivery failure if the device is offline or low on battery

Notifications are not a substitute for official emergency alert systems (e.g., Wireless Emergency Alerts, local civil defense sirens). Do not rely on MagmaSync notifications as your primary or sole source of volcanic safety information.

8. Translation Disclaimer

Translations within the App are machine-generated using Apple's on-device Translation framework. Translations:

• May be inaccurate, incomplete, or misleading, particularly for technical, scientific, or domain-specific volcanic monitoring terminology
• Are not reviewed or verified by human translators
• May not accurately convey the urgency or precise meaning of official volcanic monitoring communications

Do not rely on translated content for safety decisions. When accuracy matters, refer to the original English-language source text.

9. Intellectual Property & Third-Party Data

USGS Data: Volcano monitoring data, alert levels, aviation color codes, and observatory messages are sourced from the U.S. Geological Survey (USGS) Volcano Hazards Program. USGS data is produced by the U.S. Government and is in the public domain. MagmaSync is not affiliated with, endorsed by, or sponsored by the U.S. Geological Survey.

App Content: All original content within MagmaSync, including UI design, AI forecast models, and application code, is the intellectual property of Shuangquan Li, © 2026. All rights reserved. You may not copy, reproduce, modify, or redistribute any original content from the App without express written permission.

Apple Frameworks: Apple Intelligence and the Translation framework are proprietary technologies of Apple Inc. and are governed by Apple's own terms of service and privacy policy.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Hawaii, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Hawaii.

12. Changes to Terms

Shuangquan Li reserves the right to update or modify these Terms and Conditions at any time. Changes will be reflected by updating the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. Material changes will be noted in the App's update release notes where possible.
